These Terms and Conditions (“Terms”) are between DestiDome LLC, doing business as Amara Voyages (“Agency”, “I”, we, us, or our), and the traveler(s), customer(s), and/or purchaser(s), (collectively as You and Traveler). These Terms govern your use of our website and services. By using our website and engaging with our services, you agree to comply with and be bound by these Terms.
1. General Information
Amara Voyages is a travel agency offering personalized travel planning and consultancy services. By accessing and using this website or engaging with our services, you agree to these Terms.
2. Services
Amara Voyages provides customized travel itineraries, travel booking, and consulting services. We work with third-party vendors for accommodations, tours, and other travel services. While we take all necessary precautions to provide you with a seamless experience, we cannot be held liable for third-party errors or cancellations.
3. Booking and Payments
- To secure any travel booking or service, a deposit or full payment may be required.
- Payments for travel services may be processed by third-party payment processors. You agree to abide by their terms and conditions as well.
- Payments made to Amara Voyages for their services are non-refundable unless otherwise specified in the booking terms or agreement.
4. Travel Insurance
For your protection, we strongly recommend that clients purchase travel insurance to protect against unforeseen circumstances such as cancellations, delays, or lost baggage. Amara Voyages is not responsible for providing or managing travel insurance.
5. Cancellations and Refunds
- Cancellations made by the client may be subject to cancellation fees as per our agreement (Agency fees of USD $150.00) and third-party providers’ terms.
- Refunds, if applicable, are determined by the policies of the third-party service providers and the specific terms of your booking.
- Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you
- Agree to indemnify us for that fee or charge.
6. Client Responsibilities
- Clients are responsible for ensuring their passports, visas, and any other necessary documents are up to date.
- Clients should inform Amara Voyages of any special requests, dietary restrictions, or medical conditions that could affect their travel.
- Clients should ensure they are aware of any health requirements for their travel destinations and to ensure that you carry all necessary vaccination documentation.
- Frequent flyer numbers must be supplied to Amara Voyages along with the reservation if air transportation has been requested. Travelers are responsible for reconfirming their number with the airline upon check-in for flights.
7. Limitation of Liability
- Amara Voyages is not liable for any loss, injury, or damage that may occur during the travel experience, including but not limited to changes in travel plans, accidents, or health-related issues.
- We act only as agent for the contractors providing transportation, accommodation or other services. We do not guarantee the availability of any third-party services, including accommodation or excursions, and are not responsible for any issues arising from these services. Amara Voyages is not responsible for omissions in prices and programs.
- We may book wellness travel for clients, including yoga, meditation, Medi-spa, and other activities aimed at improving health and well-being. We do not have specialized knowledge of the practices or qualifications of the professionals offering these activities and make no guarantees of improvement in your well- being. We are not responsible for any worsening of conditions, injuries, illnesses, or loss of life resulting from participation in these activities. You acknowledge the risks involved and voluntarily participate, assuming all associated risks, including travel to and from the activities.
- Amara Voyages shall not be responsible in any way for loss, injury or damage arising from an Act of God, Acts of Governments or de facto authority, war, civil unrest, any kind of hostilities, strikes, theft, sickness, quarantine, immigration or customs regulations, hijacking, acts of terrorism, breakdown, cancellation, error, omissions or any other cause beyond our control. Amara Voyages reserves the right to make any changes to a tour which it deems to be in the best interests of the passengers, in agreement with the client.
- Any deposit paid for a package offered by Amara Voyages is considered acceptance and acknowledgement of prices, exclusions, conditions, and responsibilities as stated above and releases Amara Voyages and all of its agents and representatives from any and all liability, actions, causes of actions, suits, debts, demands that you may have in connection with your participation in an Amara Voyages trip or activity.
8. Privacy Policy
We respect your privacy and handle your personal information according to our Privacy Policy. By using our services, you consent to our privacy practices as outlined below.
- We do not share, sell, and will not otherwise exchange your information when anyone else except where required by law.
- We only use the personal information you provide to us, and we request your consent for us to email you. By using the Service, you agree to the collection and use of information in accordance with this policy.
- While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name (“Personal Information”). This information is only requested when you decide to provide it via one of the information collection forms.
- We have no liability regarding the distribution of your information to any Supplier or any Supplier’s failure to protect your personal information.
- We collect this information for the purposes of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your planning needs, and improving our services.
- We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by contacting us.
- The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, to protect it from unauthorized access, destruction, use, modification, or disclosure.
However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.
Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
9. Arbitration
- In case of a dispute between the you and Agency relating to or arising out of these Terms, the parties will first attempt to resolve the dispute personally and in good faith.
- If personal resolution attempts fail after 60 days following written notice of dispute, the parties will submit the dispute to binding arbitration, and the alleged acts or omissions of any or all the parties hereunder shall be resolved by arbitration in accordance with the Federal Arbitration Act 9 U.S.C. § 1 et. seq. and the rules and procedures of the arbitration company selected to administer the arbitration.
- The arbitration will be conducted as follows:
- State of Georgia, County of Cobb.
- The arbitration will be conducted by a single arbitrator.
- Such an arbitrator will have no authority to add parties, vary the provisions of these Terms, award punitive damages, or certify a class.
- The arbitrator shall be bound by applicable and governing federal law as well as the law of the State of Georgia, County of Cobb.
- Attorney’s Fees: Each party will pay its own legal costs and fees. The prevailing party shall be entitled to recover its actual attorney’s fees, reasonably incurred.
10. Statute of Limitations
All claims of any nature whatsoever against DestiDome LLC dba Amara Voyages, whether asserted in litigation or arbitration must be brought within one (1) year from the date any claim or cause of action arises. Such actions shall thereafter be time-barred.
11. Intellectual Property
All content on the Amara Voyages website, including but not limited to text, graphics, logos, and images, are the property of Amara Voyages or licensed to us. You may not use any content from this website without prior written permission.
12. Governing Law
These Terms and Conditions are governed exclusively by the laws of the state of Georgia, and any disputes will be resolved under the jurisdiction of the courts in the State of Georgia, USA.
13. Modifications
We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and the “Revised Date” will be updated. Your continued use of our services after such changes will signify your acceptance of those modifications.
